गृह मंत्रालय ने अभी हाल ही मे आदिवासी जिलों के पुलिस अधीक्षकों को बुला कर आदेश दिया है कि मानवाधिकार की आवाज़ उठाने वाले संगठनों और व्यक्तियों को जेलों मे डालना शुरू कर दिया जाय
तो जनाब कमजोरों पर ज़ुल्म होता देख कर या तो चुप हो कर घर बैठे रहिये या ज़ुल्म का विरोध कर के जेल जाकर पिटने के लिये तैयार हो जाइए .
और मज़े की बात तो यह है कि आप नक्सल समर्थक हैं या नहीं यह घोषित कर के मानवाधिकार कार्यकर्ताओं को जेल मे ले जाकर पीटने का अधिकार किसको होगा ?
१ - अमीरों से रिश्वत खाकर गरीबों की ज़मीनें छीनने वाले पुलिस वाले आपको नक्सल समर्थक सिद्ध कर सकेंगे
२- थाने मे ले जाकर महिलाओं से बलात्कार करने वाले , औरतों के गुप्तांगों मे पत्थर भरने वाले , औरतों की योनी मे मिर्चें भरने वाले कल्लूरी और अंकित गर्ग जैसे पुलिस अधिकारी आपको नक्सली घोषित कर जेल मे डाल सकेंगे .
२- गडकरी और राबर्ट वडेरा जैसे भ्रष्ट लोगों की '' राष्ट्रवादी '' पार्टी कांग्रेस और भाजपा के '' देशभक्त'' कार्यकर्त्ता अगर आपके बारे मे पुलिस से शिकायत कर देंगे कि साहब ये व्यक्ति कम्पनी वाले सेठ को कारखाना लगाने के लिये ज़मीन देने के बारे मे आदिवासियों को उनके अधिकारों के बारे मे बता कर भड़का रहा है तो भी आपको एस पी साहब जेल मे सड़ा देंगे .
३. आदिवासियों की ज़मीने छीनने के लिये ताक मे बैठे हुए उद्योगपति भी आपके बारे मे पुलिस अधिकारी को कह कर आपको नक्सली समर्थक कह कर जेल मे डलवा सकेंगे .
लेकिन जनाब इन होम मिनिस्ट्री मे बैठे हुए सत्ता की शराब मे धुत्त लोगों को सत्य और जनता की ताकत का पता ही नहीं है .
मैं इस पत्र द्वारा केन्द्र सरकार , गृह मंत्रालय और राज्य सरकारों को विनम्र सलाह दे रहा हूं कि आप ऐसी कोई बेवकूफाना हरकत करने की जुर्रत मत करना . वर्ना हालात् आपके हाथ से नकल सकते है .
आप ये भूल जाओ कि जनता आपकी जेल , लाठी या गोली से डर कर अपनी ज़मीनें और बेटियाँ आपको सौंप देगी .
आप को आदिवासियों और अन्य ग्रामीणों की ज़मीनें छीनने के गैर कानूनी काम मे एक एक गाँव मे एक एक घर से भयंकर प्रतिरोध का सामना करना पड़ेगा .
और अगर आपको लगता है कि अन्याय का विरोध करने को अपराध घोषित करने से लोग डर जायेंगे तो हम खुले आम घोषणा कर रहे हैं कि हम अपनी आख़िरी सांस तक प्रत्येक अन्याय का विरोध करेंगे . एक इंसान होने के नाते यह हमारा कर्तव्य और धर्म है भले ही आप हमारे इस काम को किसी भी कानून के द्वारा गैरकानूनी घोषित कर दें .

Dear all,
Upon receiving an sms alert from a senior functionary of PUCL this morning about a new set of instructions from the Union Ministry of Home Affairs to the heads of police in districts affected by Maoist/Naxal activity I have located the story published in today’s Hindustan Hindi daily (first attachment- news item is on left hand first column closer to the bottom of the page). An unofficial translation of this news item is given below:
News item from Hindustan, Date: 27th July, 2013 (Saturday), page 9
“Naxal Sympathisers may go to Jail
New Delhi: The Ministry of Home Affairs has said that a close watch be kept on front organisations of Maoist outfits and (other) organisations and individuals who sympathise with them and arrest them when sufficient evidence has been collected.
At a meeting of the Police Chiefs (SPs or SSPs) from 27 Naxal-affected districts, the Ministry said that a dossier be prepared about organisations and people supporting (encouraging) Maoists and that they be arrested. The Police Chiefs who attended the 2-day meeting told the Home Ministry that such organisations are the biggest obstacle in the campaign against Naxals. When any campaign is launched (against the Maoists/Naxals) these organisations raise the issue of human rights (violation) and try to make it a failure. Because of this (opposition) their (police) efforts are failing and the morale of the Maoists is getting strengthened.
Reacting to this the Ministry stated that an FIR (First Information Report) be filed against such organizations and their spokesperson first and then they should be arrested. (Vi.sam.)”

Later in the day I checked up with a few friends of mine in the print media. One of them covering the MHA beat confirmed that such a meeting was organised by MHA and the instructions mentioned in the news item were issued verbally. No circular/office memorandum containing these instructions are uploaded on the MHA website nor is there a mention of this meeting under “What’s New” section of the website.
The MHA has completely ignored that they must comply with Section 4(1)(c) of the Right to Information Act, 2005which requires every public authority to publish all facts while taking important decisions or making policy announcements that affect the people. Until recently the MHA website proudly displayed that it was ranked 2nd amongst all Central Government websites for its compliance with guidelines for websites published by the Central Government, I could not find that ranking mentioned on their website today. Thanks heavens for small mercies.
The MHA’s directions to the Police Chiefs are truly worrisome. They may be in violation of the fundamental rights to freedom of speech and expression and the right to voice dissent. I will find out more about any official record of this meeting and get back to you.
Until then every organization and individual- all human rights, civil liberties, social justice organizations and movements, judges who order bail for persons alleged to be Maoists or acquit them for want of evidence, their defence lawyers, media persons and academics writing about Maoists/Naxals or police action against them better be extra cautious. Big Brother is not only watching your actions and statements but also polishing the handcuffs for use. Or will the new amendments to arrest law prevent handcuffing? Time alone will tell.
